Clever is the most widely used single sign-on platform for K-12 education, and about 30% of all students in the U.S. log into Clever monthly. Clever is used by 80,000 K-12 schools and over 350 educational application companies to make access to educational technology easy, safe, and secure.

Clever is seeking to hire its first in-house counsel. This individual will handle all of the company’s commercial and privacy matters and will provide hands-on legal counsel companywide. Given the growing importance and visibility of student data privacy in education, knowledge and experience in privacy law is a must. The ideal candidate is an experienced lawyer who is passionate about data privacy and is adept in translating legal and compliance concepts into action to help drive product development and business strategy. Because of Clever’s central role in the educational technology ecosystem and strong commitment to high privacy standards, this role is critical to Clever’s growth and thought-leadership. This is a great opportunity to take a leadership role close to the business and help craft the privacy frameworks that will govern the next generation of educational technology. 

You will:

  • Be responsible for managing all contract and legal affairs of the company with particular emphasis on privacy.
  • Collaborate with technology and product teams to implement privacy-by-design principles throughout the development of innovative new edtech products.
  • Stay abreast of evolving state and federal regulations and best practices to guide the company’s compliance approach. 
  • Negotiate contracts with customers and address privacy-related concerns and requests. 
  • Be the public face of Clever’s privacy efforts to customers and at industry conferences.
  • Work with Federal and State governments to contribute to policy development discussions as new regulations are being formed.
  • Work with national education privacy organizations in education.
  • Participate in industry forums to help shape relevant privacy and security policies and regulations.
  • Represent Clever externally before data protection regulators, industry groups and other key stakeholders.
  • Build agreement templates & manage redlines.

You should have:

  • At least 6 years of total legal experience, with 2 or more years in-house experience. Active membership in the California Bar required.
  • Experience working in a growing technology company.
  • Significant privacy law experience, particularly with CCPA/GDPR and COPPA, is required. Experience with FERPA and state student data privacy laws is a huge plus.
  • A thorough understanding of industry best practices in privacy and demonstrated success in strategic planning, program evaluation, and improvement to create and implement a vision for privacy operations. Success operationalizing a privacy program is ideal.
  • Extensive experience drafting and negotiating commercial and sales agreements with the ability to drive negotiations to conclusion.
  • Corporate governance and general corporate experience.
  • Impeccable legal and business judgment, the ability to face new challenges and the willingness to be hands on and do what it takes to get the job done.
  • Strong negotiating skills and proven ability to negotiate and close deals in a collaborative manner.
  • Excellent problem-solving skills, exceptional attention to detail, and an openness to creative problem-solving. 
  • Experience working with and managing outside legal experts for special projects.

Huge pluses: 

  • Privacy management experience in a K-12 educational context. 
  • Familiarity with national education privacy organizations (ex. Student Privacy Pledge, Student Data Privacy Coalition).
  • Experience in proactive cybersecurity and/or incident response, or working closely with security professionals to align technical processes and procedures with compliance strategies.
