We're headquartered in San Francisco, but we're building a remote-friendly team across the continental US. We were founded in 2019, and we last raised a $40M Series B in 2021. Our investors include top VCs like Activant, Accomplice, and Greycroft; founders from successful startups like Plaid, SeatGeek, and FiveStars; and executives from major sports teams like the Boston Celtics and Phoenix Suns.
The Role:
Cardless is seeking a Product and Regulatory Counsel to join our fast-growing company building custom credit card programs for brand partners. Reporting to the Chief Legal Officer, the Product and Regulatory Counsel will join a small and growing legal team and will lead the launch of our first co brand card outside of sports. You will oversee an exciting portfolio of brand partners and work with external stakeholders and advise cross-functional teams as Cardless innovates new product features, upgrades services, and expands our brand and product partnerships.
The Responsibilities:

    • Partner with and provide business-focused legal advice to Product, Marketing, Compliance, Risk, Operations, Customer Success, and Engineering teams on the launch, product features and development of Cardless' first non-sports brand partner
    • Serve as key resource to address questions and issues arising in bank regulatory and product contexts
    • Work with cross-functional teams on drafting and implementing internal compliance policies and procedures
    • Review and approve brand partner marketing campaigns and other external facing material and provide legal and regulatory guidance while advancing Cardless' business interest
    • Provide sound counsel on questions that arise related to regulatory requirements implicated as new credit card programs are being launched and existing programs are growing
    • Anticipate, identify and take appropriate action on legal and regulatory risks and liabilities across the company
    • Serve as key advisor and remain up-to-date on relevant banking, credit card, consumer financial laws and regulations


The Requirements:

    • Minimum 4+ years of experience as an attorney or in-house counsel providing legal advice and regulatory guidance to consumer-facing financial institutions
    • Subject matter expertise in banking, credit card, advertising, financial and consumer laws and regulations including the statutes and laws under the purview of the Consumer Financial Protection Bureau and Federal Deposit Insurance Corporation among other regulatory agencies. Expertise should include handling matters involving questions involving Truth in Lending Act, Reg Z, Equal Credit Opportunity Act, NACHA rules, UDAAP, CAN-SPAM, TCPA, FDCPA, FACTA, etc.
    • Proven experience guiding and enabling product launches and features in a highly-regulated fintech environment
    • Excellent written and verbal communication skills and the ability to influence both internal and external stakeholders
    • Ability to work cross-functionally within the organization and ability to thrive in a fast-paced, ambiguous and unstructured environment
    • Active bar license and in good standing with the Bar Association or currently serving as Registered In-House Counsel


Location

Compensation
This role has an annual starting salary range of $170,000 - $210,000 + equity + benefits (see above). Actual compensation is influenced by a wide array of factors including but not limited to skills, experience, and specific work location.
