The Challenge
Let’s face it, managing personal finances is hard. 70% of Americans struggle with at least one aspect of financial stability, 1 in 5 has no retirement savings, the average college student graduates with $37,000 in student loans, and the national credit card debt is over $1 trillion. At Digit, we’re building a smart financial assistant to help make financial health effortless for everyone.
We have a collaborative, diverse, and supportive culture and we look for people who are curious, ambitious, and mission-driven. If you're passionate about making an impact and helping real people every day we're excited to meet you!
The Role
We are looking for an experienced lawyer to help build out our Legal department as we grow our products. In this role you will spot and shepherd risk across our entire organization. You’ll be a thought partner with product managers, a regulatory lawyer who can get answers in gray areas, an issue-spotter, a sounding board for questions, and a jack-of-all trades who can learn any new skill. This role reports to our General Counsel.
What You’ll Do:
You’ll wake up and go to work (remotely or otherwise) with people who are aligned in our mission. You will own a piece of that, both in stock options and in role. You will get a chance to help shape a Legal department. As we build new products, you’ll build some of it from the ground up. You’ll have voice and ownership. You’ll have a safety net when you need it, but you’ll also be able to use your past experience to spread your wings and build new things. You’ll learn a ton and join a respectful, collegial, engaging, and welcoming team that cares about responsible innovation.
More specifically:

  • Product Development: Product to drive responsible innovation. We move money, park it in safe places, open new accounts, drive investments, partner with banks, recommend portfolios, etc. We touch a little bit of everything, and you will too. You’ll need to provide the business with thoughtful, actionable, responsible guidance so that we can build products that (brace for it) INNOVATE while also staying true to our mission, our standards, and our compliance framework.
  • Regulatory Advisory: You’ll get hard questions and will need to get to good answers. You’ll start with research and brainstorming. For the toughest ones, maybe you phone a friend, maybe we work with experts in the area.
  • Contract Negotiations: We sign a ton of contracts: NDAs, bank partnerships, SaaS, data storage, money movement, etc. You’ll help with the negotiations and documenting the solutions.
  • Intellectual Property: You’ll help us protect our IP. We’ll train employees on protecting trade secrets and reducing IP risk. We’ll file for trademarks, advise on open-source licensing, know when to secure releases, etc.
  • Marketing: Work with our marketing team to review all outgoing material.
  • Audits and Examinations: Provide support to Compliance, Senior Leadership, Operations, Finance, and all other departments in preparing for and executing responses for regulatory, bank partner and other external audits and examinations.
  • Education, Training, and Promoting a Culture of Compliance: Work with Compliance to develop, enhance, and deliver compliance-related training to all employees, including training specific to rules, regulations, standards, and resources, such as Annual AML & SEC Code of Ethics training.

Who You Are:
Must-haves:

  • Experience at a law firm and/or regulated company (6 years minimum) and know at least 4 of these 5 things pretty well: (1) Bank Regulatory (AML/Reg E/Disputes/GLBA/Lending/ESIGN/UDAAP/FCRA), (2) Money Movement (ACH, RTP, credit card networks, NACHA, fraud), (3) Technology (APIs, oAuth, SaaS, mobile apps, product development, information security, data storage and usage, general understanding of “full stack”), (4) marketing review (UDAAP, working with testimonials, IP issues), (5) Licensing/Regulatory Relations.
  • This role involves influencing across departments, so knowing how to build trust and be a problem-solver (and come across as a problem-solver) is critical.
  • You’ve partnered with Product before, hopefully by embedding in the team.
  • You care about financial health, as it’s the core of what we do.
  • You’re curious, like a cat. Maybe your friends even call you “Whiskers.” You hear about something you don’t know and you feel a need to learn it. You don’t need to know everything, but you will need to know how to use your resources (regulatory guidance, your network, Slack, journals, books, Bing, law firms) to find the answer to just about any question.
  • You can take something complex and make it simple. You know how to pause, take a breath, and translate from lawyer-speak (e.g., all those acronyms) to something the audience in front of you will grasp.

Now for the optional stuff.

  • You’ve worked with a Compliance department before and helped them structure policies or deal with complex issues.
  • You’ve worked for a Regulator (FTC, CFPB, DBO, OCC, etc.) or at a law firm doing bank advisory work.
  • You’ve conducted company trainings and/or create slides without a ton of long bullet points.
  • You’ve been involved in an audit and/or preparing for one (e.g., with a bank partner).
  • Experience with anti-fraud measures (ID verification, transaction monitoring, internal controls, Red Flags rules, anti-phishing).
  • If you listen to any of the Legal podcasts (e.g., Firmly Held, Frolic and Detour, The Attractive Nuisance, Bob Loblaw’s Law Blog, Mildly Appealing), huge bonus. (None of those are real.)
