Legal at Brex

The Legal team helps the company grow responsibly, advocating for Brex and for the thousands of growing businesses we serve. We provide strategic advice and guidance to all Brex teams, protect Brex, advise on risk, and represent the company externally, negotiating with partners and interacting with regulators. What you’ll do

As Commercial Counsel at Brex, you will be a key member of the Legal team, supporting and negotiating revenue-generating agreements that enable Brex’s sales, partnerships, and go-to-market teams. You will also negotiate and advise on inbound vendor and procurement agreements, helping teams across the company operate efficiently and securely. You will manage a high volume of commercial transactions, driving deal velocity while thoughtfully allocating risk in a complex fintech environment. You’ll provide clear, pragmatic guidance on legal issues arising in commercial transactions, and collaborate closely with sales, deal desk, partnerships, privacy, procurement, security, product, and engineering. You will contribute to the ongoing development of Brex’s commercial legal resources, including playbooks, templates, policies, and workflows that improve consistency and support scalable growth. Throughout, you will balance risk management with business objectives and serve as a reliable partner to the business.

Where you’ll work

This role will be based in our San Francisco office. We are a hybrid environment that combines the energy and connections of being in the office with the benefits and flexibility of working from home. We currently require a minimum of two coordinated days in the office per week, Wednesday and Thursday. Starting February 2, 2026, we will require three days per week in the office - Monday, Wednesday, and Thursday. As a perk, we also have up to four weeks per year of fully remote work!

Responsibilities

  • Draft, review, and negotiate revenue-generating agreements with Brex’s customers and partners
  • Draft, review, and negotiate inbound commercial contracts, including technology agreements, master and professional services agreements, consulting contracts, and marketing and event agreements.
  • Contribute to the continuous improvement of commercial legal processes and resources, including developing and refining contracting playbooks, templates, policies, procedures, and workflows. Leverage and optimize contract lifecycle management (CLM) systems and AI contracting tools.
  • Identify and mitigate contractual risks, escalating complex issues to senior legal team members as needed.
  • Provide sound, business-oriented legal advice to cross-functional partners on contract terms, deal structures, and commercial legal risks and opportunities.
  • Collaborate closely with internal stakeholders to understand business needs, contextualize transactions, and translate business, operational, and product requirements into clear legal terms and conditions.
  • Be a business partner, not just an attorney. 

Requirements

  • Strong contract drafting skills with attention to precision and clarity. 
  • Demonstrated experience negotiating technology and commercial agreements with sophisticated counterparties. 
  • 3 to 5 years of experience practicing commercial law, either in-house at a technology or financial services company or within the corporate or technology transactions department of a reputable law firm. 
  • Juris Doctor (JD) and active bar membership in good standing in at least one US jurisdiction.
  • Exceptional judgment, attention to detail, and integrity, with the ability to manage multiple priorities and deadlines in a fast-paced environment.
  • Entrepreneurial, builder-oriented mindset with a willingness to take ownership and contribute to the continuous improvement of internal processes and resources.
  • Flexible, adaptive, and always open to learning something new.
  • Sense of humor and ability to maintain perspective in a fast-paced environment.

Bonus Points

  • Working knowledge of privacy issues in a commercial context. 
  • Fintech experience or familiarity with financial services product structures.Experience working with contract lifecycle management (CLM) technology or AI-native contracting tools.

Compensation

The expected salary range for this role is $220,000-$270,000 USD.  However, the starting base pay will depend on a number of factors, including the candidate’s location, skills, experience, market demands, and internal pay parity. Depending on the position offered, equity and other forms of compensation may be provided as part of a total compensation package.
