Work closely with the Managing Director-Head of Compliance in supporting the firm’s overall governance framework ensuring compliance with regulatory, investor, and internal requirements. This includes: i) federal/state/municipal regulations and requirements for a nationwide mortgage lender and loan servicer, ii) , investor contracts/agreements/guides/obligations as a counterparty to Fannie, Freddie, FHA/Ginne Mae and other lending sources, and iii) Cantor/Newmark policies & procedures.
Definition of Success:
No federal/state/municipal regulatory lapses, penalties, or findings, satisfactory or better audits findings (external and internal), and no non-compliance findings with corporate policies & procedures.
ResponsibilitiesPolicies & Procedures: own administration of policies and procedures, including a centralized location providing ease of access, consistent of format/content, and ensuring they are up to date.
Compliance Deliverables: review new agreements/contracts and Agency Guide updates for recurring compliance deliverables and update our tracking tool as necessary to capture.
Complete or provide oversight of Agency and HUD/Ginnie Lender and Officer Certifications/Attestations, Financial Reporting, Evidence of Insurance, Limited Power of Attorney, Suspicious Activity Log, Audits, and other deliverables as they arise.
Coordinate the creation and distribution of Annual Officer’s Certifications for Master Servicers, Life Companies, and other recipient’s as necessary, ensuring deadlines are met per Servicing Agreements.
Coordinate the distribution of Annual Compliance items including but not limited to; E&O Insurance Coverage, RegAB & USAP Audit Opinion Letter and Financial Statements per Servicing Agreements ensuring NDAs are current where appropriate.
Coordinate the review of the annual Management Rep Letter for RegAB with the firm’s auditor, senior management, internal legal counsel, and external counsel.
Ensure authorized representatives are filed and current with our investors, and any necessary notifications of additions are departures are performed within required timelines.
Reporting: maintain and distribute the Quarterly Compliance Report documenting the status of our compliance efforts.
Work closely with the Managing Director in supporting the administration of audits/rating reviews including scheduling/planning, tracking deliverables, collecting & reviewing materials, escalating issues/concerns, responding to requests, and follow up on findings/remediation as necessary.
Regulatory: maintain Regulatory Policy is up to date and communicated to teams to ensure the firm complies with lending, brokering, and servicing licensure requirements. Work with regulatory counsel to ensure we stay current with state and federal requirements, we provide periodic reporting to the appropriate agencies as required, and NMLS properly reflects our compliance status.
Governance: Take the lead in managing Corporate Authorities, carry out document retention actions per the Document & Information Governance Policy, compliance with mandatory training is completed by all users, insurance coverage (HUB and Marsh) is renewed annually (up-do-date Insurance Certificates maintained on SharePoint site) and work with the Cantor Tax Department to ensure tax assessments are paid for BPC.
Manage and develop the GST team resource(s) by delegating down the majority of administrative tasks and assuming a review and approval role.
Perform periodic Wire Audit of Servicing, Production, Closing and Business Support. and external counterparts and install confidence in compliance framework and abilities.
Must display a high degree of initiative, task ownership, ability to work with minimal supervision, with an attention to detail.
Ability to organize and prioritize projects; complete multiple tasks on schedule, and function as a committed team player.
Strong written and verbal communication skills; must be able to communicate with others at all levels – internally and externally.
Must be able to research, problem solve, and resolve matters as they arise.
BA/BS degree in finance, accounting, real estate or other business related field preferred.
10 years loan servicing portfolio management experience including knowledge of GSE and CMBS products.
Strong working knowledge of loan servicing systems and proficiency with MS Office Word and Excel.
